McNair's DUI case likely to be dismissed Friday


Nashville, TN (Sports Network) - Nashville prosecutors will ask to have drunken driving charges dropped against Tennessee Titans quarterback Steve McNair after a ruling that police didn't have sufficient cause to pull him over.

District Attorney Torry Johnson announced he will not appeal the decision made two weeks ago by Judge Cheryl Blackburn that effectively threw out all police evidence in the case, including a breathalyzer that showed McNair was drunk. Johnson is expected to ask Blackburn to dismiss the case at Friday's hearing.

McNair, the NFL's co-MVP in 2003, was arrested in May 2003 while driving an SUV in downtown Nashville. His blood alcohol content was determined to be 0.18 percent, almost twice the 0.10 legal limit at the time of the incident.

In last month's decision, Blackburn ruled that a police video didn't show McNair's vehicle weaving outside his lane of traffic and that the arresting officer did not have a reason to pull over the Titans' signal-caller. That ruling deemed all evidence gathered after the stop, including a gun found in McNair's car and the blood alcohol test, was excluded.

Johnson commended the judge, saying Blackburn made the decision based on the law and not celebrity.

McNair had the best season of his career in 2003, as he threw for 3,215 yards, with 24 touchdowns and just seven interceptions. McNair has never thrown more interceptions than TDs in his career, and has 132 career scoring tosses, compared to just 83 interceptions.
